This is a legal agreement between you, the potential user (“You”) and The Closet, its subsidiaries, and its affiliates.

These Terms of Use (“Terms”) govern the access or use by You of the applications, websites, contents, products, and services (“the Services”), being made available by The Closet.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THIS WEBSITE OR SERVICES. Your access or use of The Closet’s products, services, website located at URL: https://www.thecloset.co.in/ (“Site”), mobile site, or any associated platform (collectively called the “Platform”), is conditioned on your acceptance, without modification, of these Terms. If you do not agree to these Terms, you should not use the Services.

By using The Closet Services in any way, you accept these Terms. This includes provisions in this document, as well as those in the Privacy Policy and any additional terms that you agree to.

This platform is owned and operated by The Closet, located at Ajay Ahuja Nagar, Kota, Rajasthan – 324010, India.

1. Legal Framework

These Terms are published and shall be construed in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 under the Information Technology Act, 2000, which requires publishing the rules and regulations, privacy policy and user agreement for access or usage of the Platform.

These Terms are an electronic record in terms of the Information Technology Act, 2000 and applicable rules. This electronic record is generated by a computer system and does not require any physical or digital signatures.

2. User Agreement

All references to “You” or “User” mean any natural or legal person that accesses, uses, or agrees to become a buyer by registering on the Platform in order to avail the Services.

This Agreement/Terms of Use are for an indefinite period. The Closet may, at its sole discretion, modify these Terms at any time, without prior written notice. You should review these Terms periodically. If you do not agree with the changes, you must stop using the Services. Continued use means you accept the updated Terms.

3. Eligibility

• You must be at least 18 years old to form a binding contract.
• If you are under 18, you must have parental/guardian consent to use the Services.
• The Closet reserves the right to refuse, suspend, terminate, or block access if you are underage or your use is unlawful.

4. Charges

• Access to the Website is free. However, The Closet reserves the right to charge subscription or membership fees for certain Services.
• You are responsible for internet/data charges, equipment, and any third-party fees required to access the Services.

5. Payments

We enable online payments through secure payment gateways. Accepted payment methods include:

• Credit Cards (Visa, MasterCard, etc.)
• Debit Cards
• Net Banking
• UPI
• Wallets & Cash Cards
• Cash on Delivery (COD, if applicable, within India only)

International customers may pay via internationally accepted cards or PayPal (if enabled).

6. Intellectual Property Rights

Unless otherwise stated, all materials including but not limited to text, images, designs, software, logos, and trademarks are the exclusive property of The Closet.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes only.

Unauthorized use (copying, modifying, distributing, reselling) is strictly prohibited and may lead to legal action.

7. Products & Pricing

• The Closet sells Kota Doriya Sarees, Stitched Suits, and Unstitched Suits.
• Product descriptions, prices, and images are provided with reasonable accuracy, but errors may occur.
• Prices are in INR (₹) and may be updated without prior notice.
• If an order is placed at an incorrect price, we may cancel it and refund your payment.

8. Orders, Shipping & Delivery

• Orders are processed within 48 hours (business days) and shipped to the address provided.
• Delivery timelines depend on your location.
• For international orders, import duties and taxes may apply and are the customer’s responsibility.
• Risk of loss passes to you once the order is handed over to the courier.

9. Returns & Cancellations

• 48 Hrs Easy Return policy applies. Items must be unused, with original tags and packaging.
• Some categories (e.g. clearance, sale, or custom-stitched items) may be non-returnable.
• Refunds are initiated after quality checks and processed to the original payment method.

10. User Accounts

• To place orders or use features like wishlist, you may register an account.
• You must provide accurate details and maintain confidentiality of your account credentials.
• You are responsible for all activities under your account.

11. Prohibited Activities

You agree not to:

• Use the Site for unlawful purposes.
• Attempt hacking, spreading malware, or disrupting the Site.
• Violate intellectual property rights.
• Misuse customer data or impersonate others.

12. Disclaimer of Warranties

The Closet provides Services “as is” and “as available”.
We make no guarantees that the Website will be error-free, uninterrupted, or meet your expectations.

13. Limitation of Liability

The Closet shall not be liable for indirect, incidental, or consequential damages. Our maximum liability is limited to the amount paid for the product in dispute.

14. Indemnification

You agree to indemnify and hold The Closet harmless from any claims, damages, or losses arising from:

• Breach of these Terms
• Violation of applicable laws
• Misuse of the Platform

15. Governing Law & Dispute Resolution

• These Terms are governed by the laws of India.
• Jurisdiction shall lie exclusively with the courts of Kota, Rajasthan, India.
